## Terms and Conditions

These Terms and Conditions govern your access to and use of christophercook.co and any related services provided by **Christopher Allen Luxury Productions LLC, doing business as Christopher Cook Photography** (collectively, the “Site” and “Services”). By accessing the Site or using the Services, you agree to these Terms.
### 1. Who We Are
The Site and Services are operated by **Christopher Allen Luxury Productions LLC, doing business as Christopher Cook Photography** (the “Company,” “we,” “us,” or “our”).
### 2. Eligibility and Information You Provide
You agree to provide accurate, current information when you submit a form, make an inquiry, request a quote, book services, or otherwise communicate with us. You are responsible for maintaining the confidentiality of any login credentials for third party platforms you may use to access deliverables.
### 3. Services and Bookings
Our Services may include photography, production services, digital deliverables, consultations, and related offerings described on the Site or provided in writing.
Project details, deliverables, timelines, fees, usage rights, and any special terms may be set out in a separate proposal, invoice, or contract. If there is a conflict between these Terms and a signed contract, the signed contract controls.
### 4. Payments, Deposits, and Refunds
Unless otherwise agreed in writing:
* Fees, deposits, and payment schedules are due as stated on your invoice or contract.
* Late payments may delay delivery timelines.
* Deposits are generally non refundable and reserve your date and production time.
### 5. Cancellations, Rescheduling, and No Shows
If you need to cancel or reschedule, notify us as soon as possible. Cancellation and rescheduling terms may be stated in your contract or invoice. If no specific terms are stated, we will apply a reasonable policy based on scheduling impact, pre production work completed, and date availability.
### 6. Client Responsibilities
You agree to:
* Provide timely communication, access, and approvals when needed
* Ensure you have permission to use any locations, music, logos, trademarks, or content you ask us to include
* Obtain model, property, or venue permissions when applicable, unless we agree otherwise in writing
### 7. Intellectual Property and Website Use
All content on the Site, including text, images, branding, designs, and portfolio materials, is owned by the Company or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without written permission.
### 8. Deliverables and Usage Rights
Unless otherwise agreed in writing, you receive a limited, non transferable license to use delivered materials for their intended purpose. Additional licensing, commercial usage, advertising usage, or redistribution may require separate written permission and fees.
### 9. Portfolio and Promotional Use
Unless your written contract states otherwise, you grant the Company permission to display final work for portfolio, website, social media, studio samples, and marketing. If you need a confidentiality or non display agreement, request it in writing before the project begins.
### 10. SMS and Text Messaging Terms
If you submit your phone number, you consent to receive text messages related to our Services, such as scheduling, confirmations, reminders, service updates, and support.

Opt out: Reply STOP to cancel texts at any time.

No sale for marketing: We do not sell your phone number or share SMS opt in consent with third parties for their own marketing.
### 11. Age Restrictions
You must be **18 years or older** to use the Site or Services, submit forms, book services, or opt in to receive SMS messages. By using the Site or Services, you represent that you are at least 18 years old.
### 12. Carrier Liability
Carriers are not liable for delayed or undelivered messages.
### 13. Third Party Services
We may use third party tools to provide Services such as galleries, scheduling, payment processing, email, analytics, and SMS delivery. Your use of those third party services may be subject to their terms and policies.
### 14. Disclaimers
The Site and Services are provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, error free, or free of viruses or other harmful components.
### 15. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from or related to your use of the Site or Services.
To the maximum extent permitted by law, the Company’s total liability for any claim related to the Site or Services will not exceed the amount you paid the Company for the specific Services giving rise to the claim.
### 16. Indemnification
You agree to indemnify and hold the Company harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or Services, your violation of these Terms, or your infringement of any rights of another person or entity.

Your use of the Site and Services is also governed by our Privacy Policy.
### 18. Changes to These Terms
We may update these Terms from time to time. The Effective date at the top reflects the most recent version. Your continued use of the Site after changes become effective means you accept the updated Terms.
### 19. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in or serving South Jordan, Utah, unless we agree to another venue in writing.
